By visiting our site and/or purchasing bespoke artwork jewelry from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including browsers, customers, and contributors of content.

Our store is hosted on Shopify Inc., providing us with the online e-commerce platform that allows us to craft and sell custom jewelry to you.

SECTION 1 – ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products or custom services for any illegal or unauthorized purpose, nor violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms, viruses, or destructive code. A breach or violation of any Terms will result in an immediate termination of your Services.

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information) may be transferred unencrypted across networks. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Service, custom jewelry designs, or photography without express written permission by us.

SECTION 3 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete, or current. The material is provided for general information only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information. It is your responsibility to monitor changes.

SECTION 4 – MODIFICATIONS TO SERVICE AND PRICES

Prices for our custom jewelry pieces are subject to change without notice. We reserve the right to modify or discontinue any product or service at any time without liability.

Customers are solely responsible for all customs duties, import tariffs, VAT, or handling fees imposed by the destination country upon arrival.

SECTION 5 – BESPOKE PRODUCTS, PROOFS & VARIATIONS

Handcrafted Artistry: Each jewelry piece is custom-made based on user-submitted artwork using fine 18K gold and artisan enamel. Because items are individually handmade, slight organic variations in enamel saturation, line weights, and metallic borders are natural and celebrated as part of the custom craft process.

Display Accuracy: We strive to display product finishes and enamel colors as accurately as possible. However, colors may display differently across computer monitors, mobile screens, or natural lighting compared to raw paper sketches.

Design Approval: Production begins once artwork is submitted and confirmed. Customers are responsible for verifying submitted sketches, orientations, and customization notes before final confirmation.

SECTION 6 – USER ARTWORK & INTELLECTUAL PROPERTY

Artwork Ownership: By uploading children's drawings, sketches, photos, or text to Dearbond, you represent and warrant that you own or have full legal authorization and parental consent to use and reproduce the submitted artwork.

Production License: You grant Dearbond a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and adapt the submitted artwork solely for the purpose of designing, casting, enameling, and fulfilling your custom order.

Marketing Showcase: Dearbond will not use your custom finished piece or original artwork in public marketing, social media, or promotional materials without your consent.

SECTION 7 – BILLING AND ACCOUNT ACCURACY

We reserve the right to refuse or limit any order placed with us. We may, at our discretion, limit quantities purchased per person, household, or order. You agree to provide current, complete, and accurate purchase and account details (including email address, phone number, and billing information) for all orders so we can complete your transactions and contact you regarding custom artwork proofs.

SECTION 8 – CANCELLATIONS, EXCHANGES & REFUNDS

Due to the personalized nature of our bespoke jewelry:

Cancellations: Cancellations and full refunds are only accepted within 24 hours of order placement, subject to a 5% processing fee. After 24 hours, orders cannot be cancelled or refunded as casting and production have commenced.

Exchanges & Remakes: If you are unsatisfied with your finished piece, you may request an exchange or remake within 14 days of delivery by contacting service@dearbond.com. For full instructions, please review our Return and Exchange Policy.

SECTION 9 – THIRD-PARTY TOOLS & LINKS

We may provide access to third-party tools (such as upload widgets or parcel tracking platforms) and third-party links that are neither monitored nor controlled by us. We provide access "as is" without warranties of any kind. Use of any third-party links or tools is entirely at your own risk.

SECTION 10 – USER FEEDBACK & REVIEWS

If you submit reviews, creative feedback, or suggestions to us, you agree that we may, at any time, edit, copy, publish, and distribute them without restriction or compensation. We take no responsibility and assume no liability for comments posted by you or any third party.

SECTION 11 – PERSONAL INFORMATION

Your submission of personal information and design files through the store is governed by our Privacy Policy.

SECTION 12 – PROHIBITED USES

You are prohibited from using the site or its content for any unlawful purpose, or to solicit others to perform illegal acts.

You must not upload artwork that infringes on third-party trademarks, copyrighted characters, or intellectual property without proper licensing, nor submit defamatory, obscene, or harassing material. Transmitting destructive code or interfering with site security will result in immediate termination of your service.

SECTION 13 – DISCLAIMER OF WARRANTIES & LIABILITY

We do not guarantee that your use of our service will be uninterrupted or error-free. All products and services delivered to you are provided 'as is' and 'as available' for your use, without warranties of any kind, express or implied.

In no case shall Dearbond, our directors, officers, employees, jewelry artisans, suppliers, or service providers be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind arising from your purchase or use of any product.

SECTION 14 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Dearbond, its affiliates, partners, artisans, contractors, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party arising out of your breach of these Terms, your submitted artwork, or your violation of any law or third-party rights.

SECTION 15 – SEVERABILITY & TERMINATION

If any provision of these Terms is determined to be unlawful or unenforceable, that portion shall be deemed severed without affecting the validity and enforceability of any remaining provisions. The obligations and liabilities incurred prior to the termination date shall survive the termination of this agreement.

SECTION 16 – GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you custom jewelry services shall be governed by and construed in accordance with the laws of the United Kingdom.
